Essay from the year 2014 in the subject Law - European and International Law, Intellectual Properties, grade: BA Schweden, Uppsala University (Juridik), course: Introduction to European Law, language: English, abstract: Started as an economic idea to bring peace to Europe, the Union developed too many other parts of law. With more and more law created by the Union, also fundamental rights came in the Union. The Essay should show how the fundamental rights and the freedom of services interact and what the consequences for European law are.
As one of the fundamental principles of the European Union the Internal market, Art 3 (3) TEU and Art 26 (2) TFEU, includes beside the free movement of goods, persons and capital also the free movement of services. This freedom is defined in the Art 56 to 62 TFEU. It is the right to provide services, Art 56, 57 TFEU. This is more passing than the free movement of establishment defined in Art 49 TFEU. The freedom of services is a prohibition of restriction to provide services in the EU. Art 57 TFEU gives some criteria that an services need. It encases activities of industrial and commercial charter, of craftsmen and of the professions. The European Union adapted a Directive, 2006/123, that was built under EU Case Law.
